1. Operator and Scope

These terms govern access to dankylabs.com and the digital exhibitions, artwork information, and related features provided by DankLabs Gallery, JD Franky, Allee der Kosmonauten 21, 10315 Berlin, Germany.

2. Permitted Use

You may access the website and gallery for personal, lawful, non-commercial purposes. You must not interfere with the service, attempt unauthorized access, bypass security controls, scrape protected assets, or use the site in a way that infringes another person's rights.

3. Intellectual Property

Unless stated otherwise, the website, gallery environment, text, graphics, software, and original artwork presentation are protected by intellectual property law. Access to the site does not transfer copyright, trademark, publicity, licensing, reproduction, commercial, or derivative-work rights.

4. Digital Art and Tokens

If a digital artwork is associated with a blockchain token, ownership of that token records ownership of the token only. It does not by itself transfer intellectual property or commercial rights in the underlying artwork. Any rights expressly granted with a particular release will be described separately and prevail for that release.

You may not use project materials to:

• imply endorsement, sponsorship, approval, or affiliation
• create or market merchandise, derivative collections, or commercial products
• reproduce, license, distribute, or commercially exploit artwork without written permission

5. External Services

The site may link to or rely on third-party services, including hosting, email, social networks, blockchain networks, wallets, marketplaces, and decentralized storage. Those services have their own terms and privacy practices. We do not control their availability, security, or accuracy.

6. Availability and Changes

We may update, suspend, or discontinue parts of the website for maintenance, security, legal, or creative reasons. We do not promise uninterrupted availability or compatibility with every browser, device, wallet, or third-party service.

7. Liability

Nothing in these terms limits liability where limitation is prohibited by law, including mandatory liability for intent, gross negligence, or injury to life, body, or health. Otherwise, liability is limited to the extent permitted by applicable law. Mandatory consumer rights remain unaffected.

8. Governing Law

German law applies, excluding its conflict-of-law rules, while mandatory consumer protections in your country of residence remain unaffected. We are neither willing nor obliged to participate in proceedings before a consumer arbitration board.

9. Changes to These Terms

We may update these terms to reflect changes to the service or legal requirements. The date above identifies the current version. Material changes apply prospectively unless the law requires otherwise.
